Fathom SurveysSubscription Terms of Use1. Individuals are eligible to participate in Fathom Surveys only if they: a. are included under a Fathom Dynamic Data Software license b. agree to participate in Fathom Surveys at will c. release Key Curriculum Press (Key) from liability for technical, operational, and ethical problems that arise in the course of using Fathom Surveys. 2. Key does not guarantee access from all computers or with all browsers. The performance of Fathom Surveys varies with the speed of individual computers and the speed of the Web connectivity. Key makes no warranties as to the performance of Fathom Surveys or its compatibility with the computer hardware, networking software, or connectivity software of a school, its individual teachers, or its students. Participating Schools agree to accept the technology "as is." 3. Fathom Surveys subscribers will receive email bulletins each semester about the Key Online services, related professional development opportunities, and important update information regarding Key Online. 4. Term of Participation: Participation in Fathom Surveys is based on an annual subscription. 5. Fathom Surveys subscribers must complete the Ethics of Classroom Surveys tutorial, and Instructors must make deliberate efforts to discuss with their Students issues related to privacy, anonymity, and confidentiality. 6. Subscribers may issue usernames and passwords to Students (usually students) for use during the school year subject to the Terms of Use by Participating Students. Subscribers may also issue a username and password to a parent, guardian, mentor, or tutor who is helping a Student. 7. Subscribers agree: a. to advise Students of the Terms of Use and use reasonable efforts to enforce them b. not to post the school authorization code or username and password information on the Web or publicly in any other way and not to distribute the code or any username and password information to staff, to teachers not covered by the Fathom site license, or to others on or off the school site c. to cancel a Student account if the Terms of Use have been seriously compromised d. to report repeated misuse of Fathom Surveys access privileges to Key e. to act as problem-solvers for Participating Students with respect to their participation in Fathom Surveys 8. Instructors must read and approve all surveys created by their Students before making them available for student participation. Key Curriculum Press is not responsible for the content of surveys. Likewise, if the Fathom Surveys html programming is used to host a survey on another website, Key cannot be held responsible for the content, problems with the programming, or compatibility issues. 9. If these Terms of Use violate any school policies, the user agrees not to register for Fathom Surveys. 10. Cancellation of Access: Failure of the Participating User to substantially comply with the Terms of Use, as determined solely by Key, may result in revocation of the school's registration in Fathom Surveys and in cancellation of the access to Fathom Surveys granted to the school, its individual teachers, and its students. Student Terms of Use1. Your username and password and the access to Fathom Surveys that your Instructor gives you is exclusively for use by you and the other Students. Your school and Instructor have agreed to use reasonable efforts to enforce these rules: a. You are permitted to use your username and password if your class currently uses Fathom and you have been issued a username and password by your Instructor. b. You may share your username and password with a parent, guardian, mentor, or tutor who is helping you. c. You are not permitted to give your username and password to any student who is not enrolled in your Fathom-related class unless that student is personally assisting you with a Fathom survey. d. You are not permitted to post your username and password on the Web. e. You are not permitted to publicly post your username and password. f. To create surveys, you must download the Fathom Surveys extension, and your Instructor must have given you permission to upload surveys. g. Your Instructor must approve all surveys created by Students before Students participate in them. h. You must follow all school rules and policies when creating, taking, or otherwise using surveys. Failure to do so may result in discipline at your school or revocation of your Fathom Surveys privileges. |
